Does anyone else find the idea of Marcalo as a druid somewhat funny?
yes.

Slightly
Oh, and I signed the thing.

I enjoy metamorphosis, and Groves, so i had a chance to make a druid and took it, the only other class from achaea/aetolia i would make a character for is sentinels but really if you have a druid you don't need a sentinel, all the other class's are just blah.

I think what he/she is doing may be counted as identity theft which I believe would be illegal if not for the fact that IRE owns the characters and not us. However, using OOC information to scam people is the kind of identity theft that is criminal and against the law in most countries that have internet property laws. It's also dishonourable, despicable and pretty damned stupid since the original Ialie Starfall is well-known and has contacted her.
I hope the admin do something about this. I doubt they can prevent something like this from happening again though. The most we can hope for is a faster way of contacting an admin about things like this happening in future.
Needless to say, I've signed the petition. Scamming using OOC information should not be tolerated in a place like this. It falls within the same lines as hacking. If he/she had limited his/her behaviour to just stealing your name, I would feel differently about this. I don't think anyone should do anything else IC to him/her as it's on the verge of issuable as mentioned by someone earlier (and would also make the admin take her less seriously).

however Ialie Starfall is not a real name, Identity theft is when you steal everything, name, social security number, etc. Lying isn't a criminal offense, however if she tried to scam people with OOC money (dollars, euros, and others) It's illegal regardless of identity theft, if she tried to scam people with ingame gold or credits, it's not a criminal case but rather a breach of IRE policy.
ferlas2006-02-26 15:07:20
And from what people are saying she isnt really scamming anyone, just saying gimme credits please *flutter*. And then leaving after she's got them.

She is telling people that she is me from Lusternian and using that to entice people into giving her credits.

I disagree with your definition.
Ialie is a well-known name in Lusternia, and therefore throughout the IRE community. People will be more receptive and more charitable towards people they think are Ialie because they know and like her. This character has taken Ialie's name, and masquerades as her. In other words, she has stolen Ialie's identity. Thus this is identity theft. It may not satisfactorily conform to the American Legal definition of 'identity theft'... but I don't see that that makes the word inaccurate.
ferlas2006-02-26 17:33:02
Ouch she is definatly saying that?
Thats gotta be against some sort of IRE policy or something if you can prove she did.

Aiwendil was refering to the crime known as identity theft and my response was to that. And my reference accually came from the European definition.
I personally don't see it as identity theft either, as Ialie Starfall is a fictional character. If someone made an Ialie Starfall in a book or they made an Ialie Starfall in a game like WoW and SWG, nobody would be complaining.
However this doesn't change the fact that it was something very low to do, and that if people have proof, Lusternia should punish the person on Achaea or whatever.

Intellectual property then?
We could copyright our characters names hehe
Ialie2006-02-26 18:56:40
If she is telling people she is me. Then she is also taking credit for everything I have written under the name Ialie. Everything I've put on bardics and so on.
Arix2006-02-26 19:03:39
See, this is why I just use 'Arix' as most of my character names

Imagining our Marcalo as a Druid made me laugh, but I do agree that only Druids and Sentinels are... Or were interesting enough to play as on Achaea... With the stagnation there these days, I can't play there for very long at all without tireing.
The topic of this thread made me laugh a bit, I wonder if a person could try to legitimately go from Lusternia and drop into Achaea as a new character and come up with an acctual explanation and all that and get away with it... Be fun to try at least.

Apparently Tully is a forbidden name in the other IRE games--maybe an NPC name, since I couldn't use that name nor did I see any Tully's in Honours.
So I am apparently lucky this can't happen to me.

If people encounter Achaean-Ialie and think she is Lusternian-Ialie, and she uses that to her advantage, then it is Identity theft. If someone made an Ialie Starfall in a book, that would be completely different - so obviously so, that there's no point giving reasons why. If someone made an Ialie Starfall in a game like WoW and SWG and she was identified with Lusternian-Ialie, then it is exactly the same problem. This is unlikely however as there is proportionally less of an overlap of playerbase

In both instances you are warned that IRE owns everything you place/make/have and so forth, in the game, and in bardics(there is a little "all your writings are belong to us" note somewhere when you submit something). In case anyone is confused about that.
That being said I know what this person does/did and they should be held accountable for it.

Think is a word that instantly put this person of the hook even in IRE 's policies. Now I'm assuming from Ialie's concern that she claimed to be our Ialie rather then people just thinking it. It's a scam as far as IRE's policies go (from what I have seen) however it's not identity theft, you may consider it in your own definition of identity theft sure, but I do not consider it from my definition of it (which I keep in the same lines as that of the law, mainly because I need it for my profession), perhaps this is because I do not consider muds that important.
Anyways this reaffirms IRE's warning to not lend out credits. Even if you know the person.
And I signed that petition on the day it got first mentioned in this topic
