I understand what you're saying, but there is a difference between pre-emptive retribution (arresting someone based on the possibility that they might do something) and pre-emptive legislation (saying that it's illegal to kill someone before a murder has actually been committed).

Plus you have the problem of inertia. If we spend a couple years not regulating the internet, the companies that would be affected will cry even more loudly if the decision is reversed in the future.

Outside of the military, governements to not inspire innovation. Regulations tend to favour the status quo.

The law of unintended consequences tends to go against the public's interests, not towards it.



Outlawing murder, is very different than outlawing the possiblity of murder. For example, nobody can own anything that might be used to kill a person.

Regulations don't outlaw thigns, they outlaw the possibilities. In this case, the suggested regulation is not saying you can't squash internet content. The Law is saying that you can't charge different groups different amounts for different services.
