How does that surprise you? It's just like any NPC getting the kill if you've declared someone-- if anything on than a PC kills you, Avenger does not fire. It's always been that way. Lava is obviously no different...

*shrug* How often do you fight above a lava pit? As long as the system was fixed to recognise avenger status due to environmental deaths occuring shortly after aggression, I don't see why it would be illegal. Sure, your character shouldn't exactly just run into it due to fear-aura, but I can see getting gusted. Unless you're contending that if you push someone off a building, they shouldn't fall off, but if you shout BOO at them really loud, they should run flailing towards the nearest window.
